Following almost 26 hours of discussion, the representatives of the employer PJSC ArcelorMittal Kriviy Rih and labor collective, despite of disagreements, reached an agreement to create reconciliation commission for settling collective labor dispute, which was registered earlier with the order of National Mediation and Conciliation Service in Dnipropetrovsk region.
The parties have agreed to delegate 12 representatives each to the commission and that the employer will take organizational, material and technical support of reconciliation commission upon itself.
The place where reconciliation commission will work was defined as one of the premises at main administration building upon condition that the company’s administration will provide unhindered access to the territory of the plant for all members of the commission including the representatives of labor collective. The building of ArcelorMittal Academy is indicated in signed agreement as reserve venue for the commission.
The parties also included into the agreement the clause regarding non-disclosure of documents and data, which included commercial secret and other information protected by law. After adoption and signing of decisions regarding every separate demand of employees, the parties will jointly announce decisions made by reconciliation commission.
With a view to ensure adequate provision of information to the employees of PJSC ArcelorMittal Kriviy Rih and public about the progress of negotiation process and work of reconciliation commission, all messages will be announced by mutual agreement of the parties of collective labor dispute. In case if the parties will fail to reach mutual agreement, the information will be disclosed in mass media by means of simultaneous publishing of both points of view in one publication. The third party has to follow similar principle when covering the negotiations and the parties agreed to cooperate with each other.
The signed agreement also refers to the fact that video recording of the negotiations will be provided with the help of two fixed cameras: one camera from each party of collective labor dispute. Videos can be disclosed only upon mutual agreement of the parties.
The first organizational meeting of reconciliation commission, where commission’s work procedure is to be approved, is appointed for May 10.
On May 7 before the end of the business day, the representatives of the parties are to exchange draft work procedures in hard and soft copies.
