On September 5 Security Service officers came back to inspect sinter plant. Law enforcement officers jointly with Regional Environment Inspectorate performed measurements on stationary emission sources. The plant created all conditions for representatives of Security Service, which was proceeding with criminal investigation under the article 441 of Criminal Code of Ukraine (“Ecocide”).

In addition, representatives of State Nuclear Regulatory Inspectorate of Ukraine arrived at ArcelorMittal Kriviy Rih, too. They wanted to conduct another unplanned inspection on the new Continuous Casting Machine No. 3 and shared this intention with the plant, appealing to the letter No. 8/2/2-6817 dated August 21 of Head Office for Main Directorate for Counterintelligence Protection of National Economic Security Interests of the Security Service of Ukraine. However, the representatives of State Nuclear Regulatory Inspectorate of Ukraine refused to provide this letter to the company.

As the result, the company prohibited the representatives of State Nuclear Regulatory Inspectorate from performing the inspection due to a number of reasons.

First, before that, on July 24 unscheduled inspection was already performed by this agency at CCM-3. Besides, the inspectorate performed similar actions during the search carried out by SSU officers on July 21-22 as a part of above-mentioned criminal case investigation. These actions have shown that CCM-3 production complex, built as a part of investment project, does not pose any threat to the city or to the employees of the company. This fact was also confirmed by own measurements of the company.

Second, there should be more significant legal background than another letter from SSU for another inspection. Moreover, the documents provided to ArcelorMittal Kriviy Rih do not meet the requirements of the Law of Ukraine “On the basic principles of state supervision (control) in the field of economic activity”.
